Terms and Conditions

Effective Date: April 12, 2026

These Terms and Conditions govern services provided by APXEL Holdings Company, LLC dba APXEL Backflow Services (\"APXEL,\" \"we,\" \"us,\" or \"our\") to the customer (\"Customer,\" \"you,\" or \"your\").

Services

APXEL provides backflow testing, documentation, repair, rebuild, replacement, and related field services for residential and commercial customers. Service availability depends on scheduling, access, site conditions, parts availability, and applicable utility or municipal requirements.

Estimates, Pricing, and Approval

Standard pricing may be displayed on our website or discussed before service. Quoted pricing applies only to the service described and does not include unrelated repairs, hidden conditions, non-standard parts, unusual site conditions, or additional work discovered after arrival unless specifically approved.

Any repair, rebuild, replacement, or additional work outside the original scope must be approved before that work is performed.

Testing Services

Standard backflow testing is billed at the current posted rate for the applicable service area or utility. Utility-specific or portal-based submissions may carry a different testing charge where additional administrative or submission requirements apply.

Testing fees do not include repair, rebuild, replacement parts, corrective work, return trips, or special access work unless specifically stated otherwise.

Repair, Rebuild, and Replacement Services

Repair, rebuild, and replacement services are quoted or billed separately from testing unless explicitly bundled. Same-day repair, rebuild, or replacement is not guaranteed and depends on technician availability, parts availability, and site conditions.

If APXEL performs the repair or rebuild during the same service process, retesting related to that repair may be included in the repair price as stated at the time of service. If a device fails testing and repair is not performed by APXEL at that time, any later retest or return service may be billed separately.

Priority / Same-Day Service

Priority or same-day dispatch may be available for an additional fee. This fee is charged in addition to the standard service charge. Priority or same-day availability is not guaranteed and depends on route, schedule, and parts availability.

Scheduling, Access, and Site Readiness

Customer is responsible for providing safe and clear access to the device and work area at the scheduled service time. This includes unlocking gates, securing animals, providing required access credentials, and ensuring the device can be safely reached.

If the device is inaccessible, the site is unsafe, the water is not available as needed, or the appointment cannot be completed due to conditions outside APXEL’s control, APXEL may reschedule the service and charge the applicable trip or no-access fee.

Cancellations and Missed Appointments

Appointments canceled on the scheduled service date may be subject to a $25 Same-Day Cancellation Fee.

Appointments where APXEL arrives but service cannot be completed due to no access, blocked access, unsafe conditions, customer absence, or similar issues may be subject to a $40 Trip / No-Access Fee.

Payment Terms

Unless otherwise agreed in writing, payment is due upon receipt of invoice. APXEL may require payment before submission of paperwork, reports, or final documentation.

For services that require utility submission or related paperwork, APXEL may withhold final filing, submission, or release of documentation until the invoice balance is paid in full.

Taxes and Fees

Applicable taxes and clearly disclosed service charges will be added where required. Customer is responsible for payment of all approved service charges, applicable taxes, and authorized fees.

Customer-Supplied Information

Customer is responsible for the accuracy of the address, contact information, device information, utility information, and any other information provided to APXEL. APXEL is not responsible for delays, misfiling, scheduling issues, or pricing errors caused by incorrect or incomplete information supplied by the customer.

Utility and Municipal Requirements

APXEL will make reasonable efforts to complete required forms and submissions based on the information available at the time of service. We are not responsible for delays, rejections, or additional requirements imposed by a utility, municipality, inspector, or third-party agency after service is completed.

Workmanship

APXEL stands behind its workmanship on the repair work actually performed. This does not cover unrelated issues, pre-existing conditions outside the repair performed, aged or failing parts not replaced as part of the approved work, or damage caused after the service is completed.

Except as expressly stated at the time of service, APXEL does not advertise or provide a blanket warranty covering the entire assembly, unrelated system conditions, or third-party work.

Limitation of Liability

To the fullest extent permitted by law, APXEL’s liability for any claim arising out of or related to the service provided shall be limited to the amount actually paid by the customer for the specific service giving rise to the claim.

APXEL is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, business interruption, utility penalties, water interruption, or damages arising from pre-existing system conditions, concealed defects, third-party work, or customer delay in approving recommended repairs.

Photographs and Service Records

APXEL may take photographs, video, notes, and related service records for documentation, reporting, internal recordkeeping, training, quality control, billing support, or dispute resolution.

No Guarantee of Emergency Availability

APXEL may offer priority or same-day scheduling when available, but does not guarantee emergency response, after-hours response, or same-day completion for every request.

Customer Reviews and Feedback

Nothing in these Terms restricts a customer from providing an honest review of APXEL’s services. However, APXEL reserves the right to respond to false, defamatory, threatening, abusive, harassing, or unlawful statements as permitted by law.

Changes to These Terms

APXEL may update these Terms and Conditions from time to time. The version posted on our website at the time of booking or service request will control unless otherwise agreed in writing.
